The parents of Jeffrey Bordeaux Jr. filed the suit Tuesday in State Supreme Court.

The lawsuit also names Daren Venable, the man found not guilty of stabbing Bordeaux, and Delta Upsilon, the fraternity that hosted the party in January of 2011. A judge found Venable acted in self-defense and found him not guilty of second degree murder.

The lawsuit is seeking $24 million in damages; six million for each parent and $12 million for Bordeaux's estate.

The lawsuit accused the U of R and the fraternity of negligence by not taking appropriate steps to minimize the possibility of violence. It also alleges the University failed to ensure that underage drinking would not be permitted on campus and that Venable, who was 20 at the time, was drinking at Delta Upsilon's party, prior to the stabbing.

The U of R conducted is own review of the incident and concluded the college's response was "appropriate and consistent with the university's plan for dealing with emergencies." The report stated 23 recommendations that would provide better ways to detect problems on campus.

The University of Rochester says they have not been formally made aware of the lawsuit.
